شروط الاستخدامTerms of Use

تحكم هذه الشروط («الشروط») استخدامك تطبيق «بصمة» («الخدمة») على iOS وAndroid، وموقع basmapp.com، وأي خدمات أو تحديثات مرتبطة بها. وباستخدامك الخدمة أو بإنشاء حساب أو الدخول إليه، فإنك توافق على هذه الشروط وعلى سياسة الخصوصية التي تُعدّ جزءاً منها.

إذا كنت تستخدم الخدمة نيابةً عن مدرسة أو جهة، فإنك تقرّ بأن لديك الصلاحية لإلزامها بهذه الشروط. وإذا لم توافق على أي منها فلا تستخدم الخدمة.

These terms (the “Terms”) govern your use of the “Basma” app (the “Service”) on iOS and Android, the basmapp.com website, and any related services or updates. By using the Service, creating an account or signing in, you agree to these Terms and to the Privacy Policy, which forms part of them.

If you use the Service on behalf of a school or organisation, you confirm that you have authority to bind it to these Terms. If you do not agree with any of them, do not use the Service.

• «المدرسة»: المؤسسة التعليمية التي تسجّل في الخدمة وتديرها.
• «المستخدم»: كل من يستخدم الخدمة: الإدارة أو المعلم أو ولي الأمر أو الطالب.
• «المحتوى»: البيانات والنصوص والصور والرسائل والتقييمات التي تُدخل أو تُرفع عبر الخدمة.
• «المتجر»: Apple App Store وGoogle Play.

• “School” means the educational institution that registers with and administers the Service.
• “User” means anyone who uses the Service: an administrator, teacher, parent or student.
• “Content” means data, text, images, messages and evaluations entered or uploaded through the Service.
• “Store” means the Apple App Store and Google Play.

• الخدمة موجّهة لأغراض تعليمية مصرّح بها: يستخدمها الإداريون والمعلمون لمتابعة أداء الطلاب، ويستخدمها أولياء الأمور لمتابعة أبنائهم، ويستخدمها الطلاب بحسابات تنشئها لهم مدارسهم أو بتفويض منها.
• تُنشأ حسابات الموظفين والطلاب عادةً من المدرسة، وقد ينضم المعلم أو ولي الأمر برمز انضمام تصدره المدرسة. يجب أن تكون بياناتك صحيحة ومحدّثة.
• أنت مسؤول عن سرّية بيانات دخولك وعن كل نشاط يتم عبر حسابك. أبلغنا فوراً عن أي استخدام غير مصرّح به.
• لا يجوز مشاركة الحساب أو بيعه أو نقله دون موافقة مكتوبة.
• يحتفظ الطالب القاصر بحقوقه عبر ولي أمره ومدرسته، وتقع على المدرسة مسؤولية الحصول على التفويضات اللازمة لإضافته.

• The Service is intended for authorised educational purposes: administrators and teachers use it to follow student performance, parents use it to follow their children, and students use accounts created by their schools or with their authorisation.
• Staff and student accounts are normally created by the school, and a teacher or parent may join with a join code issued by the school. Your details must be accurate and kept up to date.
• You are responsible for keeping your sign-in details confidential and for all activity under your account. Tell us immediately about any unauthorised use.
• You may not share, sell or transfer an account without written consent.
• A minor student exercises their rights through their parent or guardian and school, and the school is responsible for obtaining the authorisations needed to add them.

نمنحك ترخيصاً محدوداً وغير حصري وغير قابل للنقل وقابلاً للإلغاء لاستخدام الخدمة لأغراضك التعليمية المصرّح بها، وفق هذه الشروط. ولا يشمل الترخيص نسخ الخدمة أو تعديلها أو هندستها عكسياً أو استخراج شيفرتها المصدرية أو إعادة بيعها، إلا بقدر ما يسمح به النظام صراحةً.

We grant you a limited, non-exclusive, non-transferable, revocable licence to use the Service for your authorised educational purposes, in accordance with these Terms. The licence does not include copying, modifying, reverse engineering, extracting source code from, or reselling the Service, except to the extent the law expressly allows.

تتعهد بأن تستخدم الخدمة بنزاهة، وبألا:

• تستخدمها لغرض غير تعليمي أو غير مصرّح به، أو تتجاوز صلاحياتك.
• تدخل إلى بيانات مستخدمين آخرين أو مدارس أخرى، أو تحاول اختراق الخدمة أو تعطيلها أو اختبار ثغراتها دون إذن كتابي.
• تنشر محتوى مسيئاً أو فاحشاً أو تشهيرياً أو عنصرياً أو يحرّض على العنف أو الكراهية، أو ينتهك حقوق الملكية الفكرية أو خصوصية الغير.
• تستخدم برمجيات آلية أو سكربتات لاستخراج البيانات أو لإرسال رسائل مزعجة.
• ترفع برمجيات خبيثة أو محتوى ضاراً بالأجهزة أو بالشبكات.
• تنتحل شخصية غيرك أو تضلّل بشأن هويتك أو صفتك.

You agree to use the Service honestly and not to:

• Use it for a non-educational or unauthorised purpose, or exceed your permissions.
• Access other users’ or other schools’ data, or attempt to breach, disrupt or probe the Service for vulnerabilities without written permission.
• Post abusive, obscene, defamatory or racist content, or content that incites violence or hatred, or infringes others’ intellectual-property or privacy rights.
• Use bots or scripts to scrape data or send spam.
• Upload malware or content that harms devices or networks.
• Impersonate others or misrepresent your identity or capacity.

أنت أو مدرستك تملكون المحتوى الذي تُدخلونه، وتمنحوننا ترخيصاً محدوداً لاستضافته ومعالجته وعرضه بالقدر اللازم لتشغيل الخدمة. وأنت المسؤول عن محتواك وعن امتلاك الحق في رفعه.

لا نتسامح مطلقاً مع المحتوى المسيء أو الفاحش أو التشهيري أو المنتهك لحقوق الملكية الفكرية. ويحق لنا إزالة أي محتوى نراه مخالفاً دون إنذار مسبق. ويمكنك الإبلاغ عن أي محتوى غير لائق من داخل التطبيق أو عبر info@basmapp.com، وسنراجع البلاغات ونعالجها خلال 24 ساعة.

You or your school own the Content you enter, and you grant us a limited licence to host, process and display it as needed to run the Service. You are responsible for your Content and for having the right to upload it.

We have zero tolerance for abusive, obscene, defamatory or intellectual-property-infringing content. We may remove any Content we consider in breach without prior warning. You can report inappropriate content from within the app or at info@basmapp.com, and we review and act on reports within 24 hours.

بصمة مجانية بالكامل للمدارس ولجميع المستخدمين، من إدارة ومعلمين وأولياء أمور وطلاب، ولا نفرض أي رسوم مقابل استخدامها. وتنزيل التطبيق من المتجر مجاني كذلك.

قد يحتسب مزوّد الإنترنت لديك رسوم نقل البيانات وفق شروطه، ولا علاقة لنا بها.

Basma is completely free for schools and for all users — administrators, teachers, parents and students — and we charge no fee for using it. Downloading the app from the Store is free as well.

Your internet provider may charge for data transfer under its own terms; that is outside our control.

تشرح سياسة الخصوصية كيف نجمع بياناتك ونستخدمها ونحميها، وتُعدّ جزءاً لا يتجزأ من هذه الشروط.

The Privacy Policy explains how we collect, use and protect your data and forms an integral part of these Terms.

الخدمة بما فيها التصميم والشعار والاسم التجاري والنصوص والأيقونات والشيفرة وتجربة التحفيز (الألقاب والأوسمة وقواعدها) مملوكة لنا أو مرخّصة لنا ومحمية بأنظمة الملكية الفكرية. ولا تمنحك هذه الشروط أي حق فيها غير الترخيص المحدود المذكور أعلاه. وإذا قدّمت لنا مقترحات أو ملاحظات فيجوز لنا استخدامها دون التزام تجاهك.

The Service, including its design, logo, brand name, text, icons, code and motivation experience (titles, badges and their rules), is owned by or licensed to us and protected by intellectual-property laws. These Terms give you no rights in it beyond the limited licence above. If you give us suggestions or feedback, we may use them without obligation to you.

قد نرسل إليك أو تُرسل المدرسة عبر الخدمة إشعارات تشغيلية وإدارية (كتنبيهات الحضور والرسائل المدرسية). يمكنك إدارة إشعارات جهازك من إعدادات نظام التشغيل، علماً بأن تعطيلها قد يفوّت عليك معلومات مهمة من مدرستك.

We, or your school through the Service, may send you operational and administrative notifications (such as attendance alerts and school messages). You can manage notifications from your device settings, noting that turning them off may make you miss important information from your school.

تعتمد الخدمة على خدمات أطراف خارجية (مثل المتجرين ومزودي الإشعارات والتخزين)، ولا نتحكم في توفّرها. وتنطبق هذه الشروط بينك وبين بصمة فقط، ولا تكون Apple أو Google طرفاً فيها ولا مسؤولة عن محتوى الخدمة أو صيانتها أو الدعم الفني لها أو أي مطالبات تتعلق بها. وتُعدّ Apple وGoogle طرفاً مستفيداً من هذه الشروط في ما يخص تنزيلك التطبيق من متجرها، ولها أن تُنفّذها عليك بصفتها هذه. وعليك الالتزام بشروط المتجر ذات الصلة.

The Service relies on third-party services (such as the Stores and notification and storage providers), whose availability we do not control. These Terms are between you and Basma only; Apple and Google are not parties to them and are not responsible for the Service’s content, maintenance, support or any claims relating to it. Apple and Google are third-party beneficiaries of these Terms in respect of your download of the app from their Store and may enforce them against you in that capacity. You must comply with the relevant Store’s terms.

تُقدَّم الخدمة «كما هي» و«حسب التوفر» دون أي ضمانات صريحة أو ضمنية، بما فيها الصلاحية لغرض معين أو عدم الانتهاك، إلا ما لا يجوز نظاماً استبعاده. ولا نضمن أن تعمل الخدمة دون انقطاع أو أخطاء، أو أن تكون النتائج دقيقة تماماً. والتقييمات والنقاط والألقاب أدوات تحفيزية تعتمد على مدخلات المدرسة، وليست قراراً تعليمياً أو تأديبياً نهائياً.

The Service is provided “as is” and “as available” without any express or implied warranties, including fitness for a particular purpose or non-infringement, except where the law does not allow exclusion. We do not guarantee that the Service will run without interruption or errors, or that results will be perfectly accurate. Evaluations, points and titles are motivational tools based on the school’s inputs, not a final educational or disciplinary decision.

إلى أقصى حد يسمح به النظام، لا نتحمل المسؤولية عن أي أضرار غير مباشرة أو تبعية أو عرضية أو خاصة أو عقابية، ولا عن فقد الأرباح أو البيانات أو السمعة، الناتجة عن استخدامك الخدمة أو عدم قدرتك على استخدامها. ولأن الخدمة مجانية، فإن مسؤوليتنا الإجمالية، إن ثبتت، تقتصر على أدنى حد يسمح به النظام. ولا يستبعد ذلك المسؤولية التي لا يجوز استبعادها نظاماً.

To the fullest extent permitted by law, we are not liable for any indirect, consequential, incidental, special or punitive damages, or for loss of profits, data or reputation, arising from your use of or inability to use the Service. Because the Service is free, our total liability, if established, is limited to the minimum the law allows. This does not exclude liability that cannot be excluded by law.

توافق على تعويضنا وحمايتنا من أي مطالبات أو خسائر أو تكاليف (بما فيها أتعاب المحاماة المعقولة) تنشأ عن إخلالك بهذه الشروط أو عن المحتوى الذي ترفعه أو انتهاكك لحقوق الغير، وذلك بالقدر الذي يسمح به النظام.

You agree to indemnify and hold us harmless from claims, losses and costs (including reasonable legal fees) arising from your breach of these Terms, the Content you upload, or your infringement of others’ rights, to the extent the law permits.

يجوز لك التوقف عن استخدام الخدمة وحذف حسابك في أي وقت (انظر حذف الحساب). ويحق لنا تعليق الحساب أو إنهاءه أو تقييد الوصول فوراً عند مخالفة هذه الشروط أو لحماية الخدمة أو المستخدمين أو للامتثال لنظام. ويواجه المستخدمون المسيئون حظراً دائماً. وعند الإنهاء ينتهي ترخيصك، وتبقى البنود التي بطبيعتها تستمر (كالملكية الفكرية وحدود المسؤولية والتعويض).

You may stop using the Service and delete your account at any time (see Delete account). We may suspend or terminate an account, or restrict access, immediately if these Terms are breached, to protect the Service or users, or to comply with law. Abusive users face a permanent ban. On termination your licence ends, and provisions that by nature survive (such as intellectual property, limitation of liability and indemnity) continue.

قد نعدّل هذه الشروط من وقت لآخر. وسنذكر تاريخ آخر تحديث أعلى الصفحة، ونُعلمك بالتغييرات الجوهرية بوسيلة مناسبة قبل سريانها متى أمكن. وباستمرارك في استخدام الخدمة بعد سريان التعديل تعدّ موافقاً على الشروط المعدّلة.

We may amend these Terms from time to time. The date of the latest update appears at the top of the page, and we notify you of material changes by a suitable means before they take effect where possible. By continuing to use the Service after an amendment takes effect, you agree to the amended Terms.

تخضع هذه الشروط وتُفسَّر وفق قوانين الدولة التي تقع فيها الجهة المشغّلة لبصمة، دون إخلال بأي حقوق نظامية إلزامية للمستهلك في بلد إقامته. ونشجّع على حل أي خلاف وديّاً أولاً بمراسلتنا؛ فإن تعذّر ذلك فتختص المحاكم المختصة في تلك الدولة بالنظر فيه، ما لم يقضِ النظام الإلزامي بغير ذلك.

These Terms are governed by and construed under the laws of the country where the entity operating Basma is established, without prejudice to any mandatory consumer rights in your country of residence. We encourage resolving any dispute amicably first by writing to us; failing that, the competent courts of that country have jurisdiction, unless mandatory law provides otherwise.

• الاتفاق الكامل: تمثل هذه الشروط وسياسة الخصوصية الاتفاق الكامل بيننا وبينك في موضوعها.
• قابلية الفصل: إذا تبيّن بطلان بند فتبقى بقية البنود سارية.
• عدم التنازل: عدم ممارستنا لحق لا يعني التنازل عنه.
• التنازل عن الاتفاق: لا يجوز لك التنازل عن حقوقك أو التزاماتك دون موافقتنا، ويجوز لنا ذلك عند نقل الخدمة.
• اللغة: يُعتمد النص العربي عند الاختلاف مع الترجمة الإنجليزية.

• Entire agreement: these Terms and the Privacy Policy are the entire agreement between us on their subject.
• Severability: if a provision is held invalid, the rest remain in force.
• No waiver: failing to exercise a right is not a waiver of it.
• Assignment: you may not assign your rights or obligations without our consent; we may do so on a transfer of the Service.
• Language: the Arabic text prevails over the English translation in case of difference.
